The instant writ application has been preferred by the petitioner for quashing the order as contained in Memo No.60 dated 23.01.2008, issued by the Superintendent of Police, Pakur; whereby re-measurement of height of the petitioner in the light of order passed by this Court in W.P.(S) No.2154 of 2007 was carried out by respondent No.6 who was the same person who measured earlier. The petitioner has further prayed for a direction upon the respondent Nos. 3 & 4 to personally carry out the re-measurement.

3. From bare perusal of the prayer itself it transpires that the petitioner wants that re-measurement of his height should be done by particular persons; which is not permissible in the eye of law.

4. From record it appears that petitioner had earlier moved before this Court in W.P.(S) No.2154 of 2007 and this Court disposed of the writ application by directing the concerned respondents to get the petitioner re-

measured and if the height of the petitioner is found as claimed by him i.e. 181.1 cm, then appropriate order may be passed.

5. It further transpires from perusal of the documents annexed with the writ application that the petitioner was re-measured and his height was again found to be 180 cm as against 181.1 cm. As such, his claim for appointment has been rejected.

It also appears from the averment made in paragraph-8 of the counter affidavit that the petitioner could not be selected on the ground of age; as his date of birth is 10.10.1981; whereas the cut-off date of birth was fixed at 01.04.1979; as such, he was otherwise also not qualified for appointment.

7. Thus, by going through the averments made in the counter affidavit especially in paragraph Nos.8 and 14, no relief can be granted to this petitioner.

As a result, the instant writ application is dismissed being devoid

of merit.

8. With the aforesaid observation, the instant writ application is

disposed of.
