The present writ petition has been filed for quashing the show cause notice, as contained in memo no.799 dated 19th November, 2020 (Annexure-1 to the writ petition) issued by the Special Officer of Rationing, East Singhbhum, Jamshedpur- respondent no.2, whereby the petitioner has been directed to file show cause reply within 48 hours without mentioning as to which condition of licence has been violated by the petitioner. Further prayer has been made for quashing the order, as contained in memo no.991 dated 1st December, 2020 (Annexure-3 to the writ petition) passed by the respondent no.2, whereby the petitioner’s P.D.S. Licence no.19 of 1996 has been cancelled for the alleged violation of Clause 20(XVIII) of Chapter IV of Jharkhand Targeted Public Distribution System (Control) Order, 2019 (hereinafter to be referred as ‘the Control Order, 2019’) as well as the petitioner’s P.D.S. shop has been attached with another P.D.S. shop having Licence no.03 of 2011. The petitioner has also prayed for declaration that subsequent to the Control Order, 2019 coming into force, if a grievance is made by any person, that must be investigated by the District Grievance Redressal Cell constituted under Section 15(5) of National Food Security Act, 2013 (hereinafter to be referred as ‘the Act, 2013’) and any such investigation made by the joint inspection team is illegal and contrary to the provisions of law.
