Ms Sanjay Stone Chips through Its Proprietor Sanjay Yadav Vs the State of Jharkhand

The present writ petition has been filed for quashing the order dated 28^th December, 2019/30^th January, 2020, as contained in Process no.113 dated 30^th January, 2020, passed by the Certificate Officer, Mines, North Chhotanagpur Circle, Hazaribagh- respondent no.3, whereby the petitioner’s objection filed under Section 9 of Bihar & Orissa Public Demands Recovery Act, 1914 has been rejected by confirming the requisitioned amount.

Having heard learned counsel for the parties and keeping in view that the petitioner has efficacious/statutory remedy of preferring appeal against the impugned order passed by the respondent no.3, I am not inclined to entertain the present writ petition at this stage and the same is, accordingly, dismissed as not maintainable.

The petitioner is, however, at liberty to take alternative/statutory recourse available to it against the impugned order passed by the respondent no.3.
