It is submitted by the learned counsel for the petitioner that the opposite party No.2 was earlier granted the privileges of anticipatory bail by this Court in terms of order dated 14.06.2019 passed in A.B.A. No.3558 of 2019 but he could not furnish the bail bond in terms of the said order passed in the anticipatory bail application but instead surrendered before the court below and filed regular bail before the Judicial Commissioner, Ranchi and provisional bail was granted to the opposite party no.2 till 20.02.2020 and the matter was referred to the Mediation Centre, Ranchi and the Judicial Commissioner, Ranchi passed order for depositing a sum of Rs.25,000/- in favour of the petitioner but the opposite party no.2 did not follow the said order and ultimately the Judicial Commissioner, Ranchi rejected the prayer of bail application of the opposite party no.2. It is further submitted by learned counsel for the petitioner that the opposite party no.2 by misleading the court, has obtained the regular bail as it was submitted by learned counsel for the opposite party no.2 that the wife of the opposite party no.2 does not want to go with him, hence the opposite party no.2 could not comply the said order. Hence, it is submitted that the regular bail granted by the trial court to the opposite party no.2 in terms order dated 07.01.2021 passed in B.A. No.10608 of 2020 in connection with Lower Bazar P.S. Case No.380 of 2018 (G.R. No.1229 of 2020) be cancelled.
