This criminal miscellaneous petition has been heard through Video Conferencing in view of the guidelines of the High Court taking into account the situation arising due to COVID-19 pandemic.
Status report has been received whereby it has been informed that investigation of Nagar Untari P.S. Case No.87 of 1994 corresponding to G.R. No.453 of 1994 was stopped by the I.O. in the light of memo dated 31.01.1998 of the office of S.P., Garhwa being it arisen from same occurrence of Garhwa P.S. Case No.120 of 1995 corresponding to G.R. No.414 of 1994. Case record of Nagar P.S. Case No.87 of 1994 corresponding to G.R. No.453 of 1994 was sent to the Court of C.J.M., Garhwa from the Court of S.D.J.M., Garhwa vide order dated 22.08.2013 and this file attached with Garhwa P.S. Case No.120 of 1995 (G.R. No.414 of 1995). Further on perusal of case record of G.R. No.414 of 1995 vide order dated 15.01.1997, it appears that the accused Satyanarayan Ram has died which is also mentioned in charge sheet dated 20.05.1996 in Garhwa P.S. Case No.120 of 1995. Case of Garhwa P.S. Case No.120 of 1995 corresponding to G.R. No.414 of 1995 has also been disposed of on 29.02.2016 from the Court of C.J.M., Garhwa.
In view of above facts, this petition has become infructuous.
Accordingly, instant criminal miscellaneous petition is dismissed as infructuous. I.A. No.26 of 2012 is also dismissed.
