02/21.10.2021 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in connection with Bishunpura P.S. Case No. 30 of 2021 registered under Sections 341/323/354 of the Indian Penal Code and Section 8 of the POCSO Act.

It is submitted by the learned counsel for the petitioner that it has been alleged against the petitioner in the FIR that he had assaulted the victim girl. It is submitted that the petitioner is in custody since 28.04.2021 and hence he may be enlarged on bail.

Learned A.P.P has opposed the prayer for bail. It has been submitted that there is allegation of assault against the petitioner.

It appears from the FIR that the petitioner had teased and assaulted the informant-prosecutrix. It appears that the petitioner is in custody since 28.04.2021 i.e. for about six months.

Considering the custody of the petitioner and on the facts and circumstances of this case, the petitioner namely Chandan Chandravanshi @ Chandan Kumar is directed to be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Special Judge, POCSO Case, Garhwa in connection with Bishunpura P.S. Case No. 30 of 2021 subject to the condition that both the bailors must be own relatives of the petitioner and the petitioner will co-operate during trial and will appear in the trial Court as and when required. .
