Learned counsel for the petitioner undertakes to remove the defects, as pointed out by the office within a period of one week.

This bail application has been filed on behalf of the petitioner–Sahbaj Shekh @ Ansari @ Sahbaj Ansari with prayer to release on bail in connection with Jamtara Cyber Crime P.S. Case No.37 of 2021 registered under Sections 414/419/420/467/468/471/120-B of the Indian Penal Code and Sections 66(B)/66(C)/66(D) of the Information Technology Act pending in the court of learned Additional Sessions Judge-I, Jamtara.

Learned counsel for the petitioner has submitted that the police party had conducted raid in the house of co-accused Ghanshyam Mandal from where the petitioner other co-accused persons were arrested, who were engaged in commission of the cybercrime. It is further submitted that android mobile phones, sim cards and ATM card were recovered from possession of the petitioner and other co-accused. It is also submitted that the co-accused persons, namely, Ghanshyam Mandal and Dev Narayan Mandal have already been granted bail by a coordinate Bench of this Court vide orders dated 29^th September, 2021 and 28^th September, 2021 passed in B.A. Nos.9008 of 2021 and 9009 of 2021 respectively. The role of the petitioner is identical to that of the otheraccused persons, who have already been granted bail.

Learned A.P.P. appearing on behalf of the State vehemently opposed the contentions made by the learned counsel for the petitioner but conceded on the point of parity.

In view of the submissions made and material on record, the bail application of the petitioner is deserved to be allowed.

Accordingly, the petitioner be released on bail on furnishing

bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount to the satisfaction of the court of learned Additional Sessions Judge-I, Jamtara in aforesaid case.
