the State.
Learned counsel for the petitioner undertakes to remove the defect, as pointed out by the office within a period of one week.
This bail application has been filed on behalf of the petitioner– Neeraj Mahto with prayer to release on bail in connection with Karra P.S. Case No.36 of 2021 registered for the offence under Sections 385/387/34 of the Indian Penal Code and Section 27 of the Arms Act pending in the court of learned Judicial Magistrate, 1st Class, Khunti.
Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case and has not committed the alleged offence. No incriminating article has been recovered from the possession of the petitioner. The petitioner is not named in the F.I.R and the name of the petitioner came into light during investigation. The petitioner having no criminal antecedent is in judicial custody since 17th May, 2021.
Learned A.P.P. appearing on behalf of the State vehemently opposed the contentions made by the learned counsel for the petitioner.
In view of the submissions made and material on record, the bail application of the petitioner is deserved to be allowed.
Accordingly, the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount to the satisfaction of the court of learned Judicial Magistrate, 1st Class, Khunti in aforesaid case.
