The matter was taken up through Video Conferencing. Learned counsels for the parties had no objection with it and submitted that the audio and video qualities are good.

The present application has been filed for grant of regular bail to the petitioner in connection with Cyber P.S. Case No.09 of 2020, corresponding to Cyber Case No.09 of 2020, registered under Sections 413/ 414/ 419/ 420/ 467/ 468/ 471 of the Indian Penal Code and Section 66 (B), (C) & (D) of the Information Technology Act.

Learned counsel for the petitioner has submitted that the petitioner is in judicial custody since 07.06.2020. It has been further submitted that the investigation has already been completed and he is ready to co-operate in the trial. Although, one criminal antecedent has been reported against this petitioner but he has already been enlarged on bail in the said case vide order dated 13.06.2018 passed in B.A. No.1430 of 2018. Hence, the petitioner may be enlarged on bail.

On the other hand, learned A.P.P. has opposed the prayer.

Considering the material available on record and the period of custody, the petitioner, named above, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned District & Additional Sessions Judge-II cum Special Judge, Cyber Crime, Giridih in connection with Cyber P.S. Case No.09 of 2020, corresponding to Cyber Case No.09 of 2020 subject to the following conditions;

One of the bailer should be elder brother of the petitioner.

Petitioner will appear before the concerned police station once in a month till the conclusion of the trial.

Petitioner will submit self attested copy of his Aadhar Card and also give

his mobile number before the learned court below which he will not change during pendency of this case without prior permission of the court.
