04/06.01.2021 : The present application has been filed for grant of regular bail to the petitioner in connection with Pakur Nagar (Malpahari O.P.) Police Station Case No.189 of 2019 (Misc. Cr. Application No.516 of 2020) registered for the offence under Sections 4/5 of the Explosive Substance Act.
Learned counsel for the petitioner has submitted that the petitioner has already been granted Anticipatory Bail by a coordinate bench of this Court vide order dated 17.12.2019 passed in A.B.A. No.8359 of 2019 on the condition that he will deposit cash of Rs.60,000/- and furnishing bail bond of Rs.25,000/- with two sureties of the like amount each with direction to co-operate in the investigation. The investigation has been completed. Other similarly situated co-accused person namely Anwar @ Anu Sk. @ Anu S.K. has been granted bail by a co-ordinate bench of this Court vide order dated 17.12.2019 passed in B.A. No.11082 of 2019. The petitioner is in jail custody since 15.05.2020.
Counsel for the State has opposed the prayer for bail.
Considering the material available on record and the fact that similarly situated co-accused has already been granted bail and further the investigation has already been completed, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial
Magistrate, Pakur in connection with Pakur Nagar (Malpahari O.P.) Police Station Case No.189 of 2019 (Misc. Cr. Application No.516 of 2020), subject to condition that the petitioner will submit selfattested photocopy of his Aadhar Card and also submit his mobile number before the learned court below which he will always keep active and not change it during pendency of this case without prior permission of the court.
