Heard, learned counsel for the petitioner, Mr. Din Dayal Saha and learned Special Public Prosecutor for the State.

Learned counsel for the petitioner has submitted that petitioner has prayed for grant of regular bail in connection with Tinpahar P.S. Case No. 82/2020, for the offence registered under Sections 363, 498, 494, 379, 496, 420, 406 and 120 (B) of the I.P.C. and Sections 66A, 66B, 67, 67A, 72 and 74 of the I.T. Act.

Learned counsel for the petitioner has further submitted that earlier petitioner has lodged Complaint Case bearing P.C.R. No. 138/2020 on 15.02.2020 against (1) Mansoor Sheikh (informant), son of Haphi Sheikh, (2) Haphi Sheikh, son of Late Jahur Sheikh, (3) Lada Sheikh, son of Haphi Sheikh, (4) Manarul Sheikh, son of Late Khalil Sheikh and (5) Majid Sheikh, son of Late Khalil Sheikh, which has been brought on record as Annexure-2 of the bail application. Thereafter, complainant Mansoor Alam, son of Hafijuddin Sheikh (accused no. 1 of the complaint filed by the petitioner), has lodged Complaint Case No.357/2020 on 04.07.2020 and as such, this case is without any legal material.

Learned counsel for the petitioner has thus submitted that petitioner, who is in custody since 07.03.2021, may be enlarged on bail.

Learned counsel for the State has opposed the prayer for bail. Considering the rival submissions of the parties and looking into facts and circumstances of the case, as the petitioner has earlier filed a case against the informant of the present case, this Court is inclined to enlarge the petitioner on bail.

The petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each in connection Tinpahar P.S. Case No. 82/2020 to the satisfaction of learned Sub Divisional Judicial Magistrate, Rajmahal on the following conditions:

(i) One of the bailors shall be deponent / pairvikar of the present case namely, Majit Shekh, son of Jabbar Shekh, resident of Jamalpur, Kajigaon, P.O. - Kajigaon, P.S. - Tinpahar, District – Sahibganj, Jharkhand, who has furnished photocopy of his UID Card before this Court in the bail application.

Office is directed to send the photocopy of UID Card of deponent alongwith this order to the court below so as to verify the authenticity of the bailor .

(ii) Another bailor shall be father of the petitioner. (iii) The Jail Authority shall release the petitioner only after his medical check-up.

(iv) The Civil Surgeon, Sahibganj is directed to medically examine the petitioner at the time of his release and if he is infected with corona virus, he shall be taken for quarantine, but if no such requirement is there, he shall be released forthwith, if not wanted in any other case.

(v) The petitioner shall follow all the guidelines issued by the Government to meet the challenges of Covid-19, as presently Country is passing through pandemic of Covid-19.

Accordingly, the bail application is allowed.
