been lodged It is further submitted that though the investigation is going on since 02.06.2020 but the notary and the stamp vendor who purportedly sworn affidavits and copies of which have been filed by the informant in this case to the effect that the concerned notary has not notarised the documents and the concerned vendor has not issued the stamp paper, have not approached the investigating officer to record their statements under Section 161 Cr.P.C. nor produced the relevant documents before the investigating officer of the case and since the same are not part of the case diary, the genuineness of such document are yet to be tested so those documents cannot be considered at the stage of considering the prayer for anticipatory bail of the petitioners. It is also submitted that there is no chance of the petitioners absconding or tampering with the evidence and the petitioners are cooperating with the investigation of the case since more than one and half years and police have not found any justifiable reason to apprehend them so far and basically the dispute at best is a civil dispute. Drawing attention of this Court to Annexure-5 at page no.65 of the brief, it is submitted that the informant already approached the National Company Law Tribunal, Kolkata in the selfsame matter. It is lastly submitted that the petitioners are ready and willing to cooperate with the investigation of the case. Hence, it is submitted that the petitioners be given the privilege of anticipatory bail.
