Considering the submissions of learned counsels and the facts and circumstances stated above, I am inclined to grant privileges of anticipatory bail to the petitioner no.2. Accordingly, the petitioner no.2 is directed to surrender in the Court of learned Judicial Magistrate, Dhanbad within six weeks from today and in the event of his arrest or surrendering, he will be enlarged on bail provisionally for a period of nine months from the date of this order on furnishing bail bond of Rs.25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Dhanbad in connection with Dhansar P.S. Case No.48 of 2020 with the condition that the petitioner no.2 will cooperate with the investigation of the case and appear before the Investigating Officer as and when noticed by him and will furnish his mobile number and a copy of his Aadhar Card in the court below with the undertaking that he will not change his mobile number during the pendency of the case subject to the conditions laid down under section 438 (2) Cr. P.C. and on the petitioner no.2 satisfying the learned court below concerned that the co-accused –Anand Kumar Gupta has deposited a demand draft of Rs.10,99,500/- drawn in favour of the informant within nine months of the petitioner surrendering in the court below or in alternative the petitioner no.2 depositing a demand draft of Rs.10,99,500/- drawn in favour of the informant without prejudice to his defence in this case within a period of nine months from the date of his surrender, the provisional bail granted to the petitioner no.2 shall be confirmed.
