It has been alleged that the sister of the informant was murdered by unknown persons. Subsequently, the petitioner and other accused persons were apprehended. The petitioner had confessed and on the basis of confessional statement of the petitioner a motorcycle used in the commission of the murder was recovered.

It appears from the impugned order dated 08.02.2021 that DNA report disclosed blood positive gauge piece cutting said to be of the petitioner marked as B/3.

Learned A.P.P. was directed to clarify the aforesaid finding of the DNA report. On instruction, learned A.P.P. submits that there is no evidence that the sample of the blood taken from the petitioner had matched with the blood of the deceased.

It has been submitted that co-accused namely Mahendra Munda has been granted bail by this Court in B.A. No. 10317 of 2020. There does not appear to be any eyewitness to the occurrence and only on the basis of suspicion the petitioner has been implicated.

Regard being had to the above, the above named petitioner is directed to be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.J.C.-IV-cum-Spl. Judge POCSO, Ranchi, in connection with Sonahatu (Rahe) P.S. Case No. 19 of 2019.
