Learned counsel appearing for the petitioners submits that the allegation against the petitioners is that the petitioners along with 150-200 persons, committed dacoity in the house of the informant and looted cash, several articles and seven shops of the informant were completely damaged by using JCB machine. It is submitted that the allegation against the petitioners is false. It is further submitted that both the parties are at loggerheads and in fact, a proceeding under Section 144 Cr.P.C. was also initiated in which it was considered by the learned Magistrate that the father of the informant has sold the land, hence, they failed to substantiate their claim over the land and for the self-same occurrence, the co-accused had lodged Jagarnathpur (Pundag O.P.) P.S. Case No.185 of 2019 against the informant with resistance put up by the coaccused and others as police arrived at the place of occurrence and another case has also been instituted being Jagarnathpur (Pundag O.P.) P.S. Case No.272 of 2019. It is next submitted that the co-accused, with similar allegations, have already been given the privileges of anticipatory bail by a co-ordinate Bench of this Court vide order dated 28.01.2021 passed in A.B.A. No.7029 of 2020. It is lastly submitted that the petitioners are ready and willing to co-operate with the investigation of the case and to pay ad interim victim compensation of Rs.10,000/- each without prejudice to their defence in this case in favour of the informant. Hence, it is submitted that the petitioners be given the privileges of anticipatory bail.
