Learned counsel for the petitioner, Mr. Amaresh Kumar has submitted that the present petition has been filed for modification of order dated 28.07.2021 passed in M.A. No.342/2019, whereby this Court has directed the learned Registrar General of this Court to remit the statutory amount deposited by the appellant - Insurance Company to the learned Tribunal.

Learned counsel for the petitioner has submitted that as the entire amount has already been satisfied to the claimants along with interest, as such, statutory amount may be returned to the Insurance Company.

Learned counsel for the opposite parties has no objection and has submitted that entire amount has already been satisfied along with interest to the opposite parties, as such, statutory amount deposited by the Insurance Company at the time of preferring the appeal may be remitted to the Insurance Company.

Considering such submissions on behalf of the parties, if the learned Registrar General has not remitted the statutory amount to the learned Tribunal pursuant to the order dated 28.07.2021 passed in M.A. No.342/2019 till date, the same shall be remitted to the Insurance Company by the learned Registrar General of this Court, but if the amount has already been remitted to the learned Tribunal by the learned Registrar General, the learned Tribunal shall refund / remit the same to the Insurance Company within a period of 30 days.

Accordingly, the present C.M.P. is allowed.
