Apprehending his arrest, the petitioner has moved this Court for grant of privilege of anticipatory bail in connection with Complaint case no. 1639 of 2019 registered under Sections 498A of the Indian Penal Code, and Section 4 of D. P. Act.

Learned counsel appearing for the petitioner submits that the allegation against the petitioner is that he treated the complainant with cruelty in connection with the demand of dowry. It is then submitted that the allegations against the petitioner are all false and those allegations are general and omnibus in nature. It is further jointly submitted by learned counsel for the petitioner and learned counsel for the opposite party no. 2 that both the petitioner and the opposite party no. 2 are ready to resume conjugal life and it is agreed to between the parties that the petitioner and the opposite party no. 2 are ready and willing to appear in the court below on 29.07.2021 and from there only, the petitioner will take the opposite party no. 2 to his house to resume conjugal life . It is next submitted that the petitioner undertakes to keep and maintain the opposite party no. 2 with full dignity and honor as his lawful wife hence, the petitioner be given the privilege of anticipatory bail.

The learned Addl. PP opposes the prayer for anticipatory bail of the petitioner.

Considering aforesaid facts and circumstances of the case, I am inclined to grant the privilege of anticipatory bail to the petitioner. Hence, in the event of arrest by the police or surrender within a period of six weeks from the date of this order, the petitioner shall be released on bail on satisfying the court concerned that the petitioner has taken the opposite party no. 2 to his house and maintaining the opposite party no. 2 with full dignity and honor as his lawful wife and on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned J.M., Deoghar in connection with Complaint case no. 1639 of 2019 subject to the condition that the petitioner will continue to keep and maintain the opposite party no. 2 with full dignity and honor as his lawful wife along with the other conditions laid down under section 438 (2) Cr. P.C.

In case the opposite party no.2 fails to appear in the trial court on 29.07.2021, still the petitioner be admitted to bail on furnishing bail bond for ₹ 25,000/-with two sureties each on his undertaking to keep and maintain the opposite party number two as his lawful wife full dignity and honour, if and when she is ready to join the petitioner for leading a conjugal life.
