Apprehending their arrest, the petitioners have moved this Court for grant of privilege of anticipatory bail in connection with Potka P.S. Case No. 29 of 2019 registered under Sections 406, 409, 420, 120B of the Indian Penal Code.

Learned counsel appearing for the petitioners submits that a sum of Rs. 46,21, 867/- was allotted to Mukhiya- Rukmani Murmu of Sangram Panchayt and different treasurers under Swachha Bharat Mission(Rural) for construction of toilets and the allegations against the petitioners is that they being treasurers of their respective villages have not completed the work. It is then submitted that the allegations against the petitioners are all false and the main allegations is against Mukhiya- Rukmani Murmu of Sangram Panchayat . It is next submitted that the petitioner is ready to cooperate with the trial of the case and petitioner no. 1 is ready and willing to deposit Rs. 80,000/- with the Deputy Commissioner, East Singhbhum and petitioner no. 2 is ready and willing to deposit Rs. 20,000/- with the Deputy Commissioner, East Singhbhum without prejudice to their defence subject to final decision in the case and coaccused with similar allegations has already been granted privilege of anticipatory bail by this court vide order dated 10.12.2019 passed in ABA no. 8033 of 2019, hence, the petitioners be given the privilege of anticipatory bail.

The learned Addl. PP opposes the prayer for anticipatory bail of the petitioners.

Considering aforesaid facts and circumstances of the case, I am inclined to grant the privilege of anticipatory bail to the petitioners. Hence, in the event of arrest by the police or surrender within a period of six weeks from the date of this order, the petitioners shall be released on bail on petitioner no. 1 and 2 showing the proof of depositing Rs. 80,000/- and Rs. 20,000/- respectively with the Deputy Commissioner, East Singhbhum without prejudice to their defence subject to final decision in the case and on their furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned J.M., Jamshedpur in connection with Potka P.S. Case No. 29 of 2019 subject to the condition that the petitioners will co-operate with the Investigation of the case and will appear before the Investigating Officer as and when noticed by him and will submit mobile number and photocopy of Aadhaar card at the time of surrender in the court below with an undertaking not to change mobile number during the pendency of the case along with the other conditions laid down under section 438 (2) Cr. P.C.

It is made clear that at the time of the conclusion of the trial, the trial court will pass appropriate order regarding the amount deposited by the petitioners with the Deputy Commissioner, East Singhbhum.
