It has been alleged that the informant was having acquaintance with the petitioner since 2016. She has got divorced in the year 2013 and married the petitioner and started staying together. It has further been alleged that in the year 2018, the petitioner had induced her to invest a sum of Rs.13,00,000/- in his business with the promise of giving higher returns. It has also been alleged that the petitioner had started blackmailing her and defaming her in the society and an attempt was also made to commit her murder by the petitioner as well as brother in law and the first wife.
It has been submitted by the learned counsel for the petitioner that the amount of Rs.13,00,000/-, which was alleged to have been taken from the informant, was actually deposited in the business account of the wife of the petitioner. It has further been submitted that the petitioner had never solemnized marriage with the informant. It has also been submitted that the petitioner is in custody since 5.9.2021.
Learned counsel for the informant has vehementoy opposed the prayer for bail of the petitioner and has submitted that the petitioner has solemnized marriage with the informant. It has further been submitted that an amount of Rs.13,00,000/- has been transferred through RTGS in the account of the petitioner. It has also been submitted that in the agreement to purchase the flat, the petitioner was shown as the husband of the informant and infact the petitioner had also signed in the said papers.
There appears to be an attritional relationship between the petitioner and the informant and several disputes have cropped up between them.
Considering the entire facets of the case and the fact that the petitioner is in custody since 5.9.2021, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand only), with two sureties of the like amount each to the satisfaction of learned S.D.J.M, at Jamshedpur in connection with Kadma P.S. Case No. 148 of 2021.
