Heard the learned counsel appearing for the respective parties.
So far as the defect No. 9(v) is concerned, learned counsel for the petitioner is granted one week’s time to remove the same. As regards the rest defects, as pointed out by the office, are concerned, the same are ignored.
The petitioner is an accused in connection with Tata Rail P.S. Case No. 03 of 2021.
It has been alleged that the informant was administered intoxicants by some passengers as a result of which he became unconscious. When he regained consciousness, he found that he was divested of cash, mobile, etc.
The petitioner seems to have been implicated on the self-confession rendered in Bilaspur P.S. Case 72 of 2020.
It has been submitted by the learned counsel for the petitioner that the stolen articles were recovered from the possession of one Sushil Mandal. Some of the co-accused persons similarly situated have been granted bail by this Court in B.A. No. 11372 of 2021 and B.A. No. 11421 of 2021. The petitioner is in custody since .15.07.2021.
Regard being had to the above, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, U.C.P. Tata in connection with Tata Rail P.S. Case No. 03 of 2021.
