Heard Mr. Ignatius Minz, learned counsel for the petitioner and Mr. Jayant Franklin Toppo, learned S.C (L& C)-III respondentState.

Petitioner has preferred this writ petition for payment of compensation on the land area 25 decimals which were alleged to be acquired by the Ring Road Authority.

Mr. Toppo, learned counsel for the respondent-State by way of referring para-8 of the counter affidavit submits that the State is ready to make an inquiry about the acquisition of 25 decimals of land as alleged by the petitioner, if it is found that it has been acquired, that process for compensation will take place in accordance with law. Para-8 of the counter affidavit is quoted here for ready reference:-

That it is humbly stated and submitted that it has been claimed by the petitioner that his land of Mouza-Sarwal, P.S. No. 334, Khata No. 23, Plot No. 04 and 05 measuring an area of 25 decimals more has been acquired for construction of Ring Road, but no compensation has yet been paid to him. In this regard it is stated and submitted that the construction of Rind Road, Authority is being requested to look into the matter and ensure submission of an enquiry report with regard to acquisition of the said

25 decimals of the land of the petitioner. If the construction of Rind Road Authority sends requisition for acquisition of the said 25 decimals of land for the purpose of construction of the Ring Road, necessary action for acquiring the said land shall be taken. Accordingly after observing all processes the said land shall be acquired and the compensation of the land acquired shall be paid to the petitioner, as per the Government Instruction.

In view of the submissions of learned counsel appearing for the respondents-State the respondent Nos. 2 to 4 are directed to act in view of their statement made in para-8 of the counter affidavit and decide the issue in accordance with law within a period of six weeks from the date of receipt of production of copy of this order.

Accordingly, this writ petition stands disposed of.
