no.5. Thereafter, he converted the said land into cultivating possession. During spot enquiry made by the Circle Inspector, Madhupur, it was found that the rent of the said land was not being paid by the settlee and thus Kabil Lagan Case No.01/1967-68 was instituted in the court of the Block Development Officer, Madhupur (S.P), who vide order dated 22nd March, 1968 fixed rent of the said land in Form No.3, amounting to Rs.33.56 per year for the area measuring 10.33 acres, which was to be realised from the date of vesting of Jamindari. Surendra Nath Ojha filed a petition dated 24.03.1972 in the court of Sub-Divisional Officer, Deoghar for confirmation of settlement of the land as well as fixation of rent by the Block Development Officer, Madhupur, which was registered as Rev. Misc. Case No.377 of 1971-72. The Sub-Divisional Officer Deoghar confirmed the settlement of land and accepted the rent till 1971-72. Suddenly, Madhupur Civil Administration started clearing bushes over the said land and on enquiry, the petitioners came to know that the Government has decided to open a Mahila College assuming the said land as government land. The petitioner no.1 made representations before different authorities to look into the matter. The petitioners have stated in the said representations that if there is no other option available to the administration for opening the said Mahila College, the administration should follow the process of acquisition of the said land, however, the said request was not responded. Hence the present writ petition.
