Petitioners have knocked door of this Court with a prayer for a direction upon the respondents to consider their cases for absorption in NilamberPitamber University, Medininagar, Palamau against the vacant and sanctioned posts for Grade-III and Grade-IV posts as they have been working on contractual/ casual basis since long.

Mr. Indrajit Sinha, learned counsel appearing for the petitioners submits that they have been working since long against different Grade-III and Grade-IV posts on contractual/ casual basis. There is no complaint from any quarter and they have been discharging their duties diligently and honestly with full satisfaction of all concerned. Learned counsel further submits that on the recommendations of different Committees formulated by the University, like the Syndicate, which is the governing body of the University, the nature of employment of the petitioners were converted into contractual and casual basis on Grade-III and Grade-IV posts to cope up with the immediate requirements of the University. Learned counsel submits that the seats are lying vacant and petitioners have been discharging their duties on contractual and casual basis with a low pay. Petitioners are experienced and are fully eligible to be absorbed/ regularized in service against the sanctioned and vacant posts. But instead of regularizing services of the petitioners, there is chances of they being ousted/ terminated from the service since they have knocked door of this Court. Learned counsel submits that respondents may be directed to be absorbed against those vacant posts.

Dr. Ashok Kumar Singh, learned counsel appearing for the University submits that petitioners are working on casual and contractual basis. Learned counsel however submits that suffice it would be if petitioners prefer representations before the authorities concerned, which shall be considered and appropriate order shall be passed.

Be that as it may, considering fair submission of parties, petitioners are directed to approach before the respondents to raise their grievances by filing individual representations. If petitioners file their representations, the same shall be considered within a period of eight weeks thereafter. Needless to say if petitioners are found entitled for the claim, the same shall be extended to them within a period of four weeks thereafter. However, if any adverse order is passed, the same shall also be communicated to them within a period of three weeks thereafter.

With the aforesaid observations and directions, this writ petition stands disposed of.
