06/ 21.01.2020 At the very outset, it has been submitted by Mr. Rahul Kumar, learned counsel appearing for the petitioner that for the same charges against which a departmental proceeding was initiated, a criminal case is also lodged against the petitioner. Learned counsel further submits that in the departmental proceeding, order of demotion i.e. bringing the petitioner to a lower pay-scale has been passed against the petitioner.

However, it has been argued that though during the pendency of the writ petition, the petitioner has been honorably acquitted in the criminal case but the respondents have not shown any consideration to his honorable acquittal.

Under such circumstance, I hereby direct the petitioner to approach the respondent authorities by filing a fresh representation annexing the copy of order passed in criminal case as well as a copy of this order, within a period of two weeks from the date of receipt of a copy of this order and upon receipt of the same, the respondents are directed to consider the case of the petitioner and after providing ample opportunity of hearing to him, pass a reasoned order, within a period of six weeks thereafter, taking into account the honorable acquittal of the petitioner in criminal case as well as the relevant documents brought on record at Annexures-21 and 22 of the writ petition.
