06/ 20.01.2020 The petitioner has approached this Court with a prayer for a direction upon the respondents to pay and release the retiral benefits attached to the post such as gratuity, provident fund, leave encashment etc. and to fix the family pension.
It is specific case of the petitioner that she has obtained succession certificate and as per the succession certificate, she is entitled for the benefit accrued to her as her deceased husband died in harness on 01.05.2007.
Learned counsel for the respondents very fairly submits that if the petitioner approaches with Succession Certificate, the same shall be considered in accordance with law and benefit accrued to her, shall be released to her.
In view of the submission of the learned counsel for the parties, the petitioner is directed to approach the concerned respondents by filing a representation annexing the succession certificate, within a period of four weeks’ from the date of receipt of a copy of this order. On receipt of the same, the respondents shall verify the succession certificate and release the benefits as per her entitlement, in accordance with law, within a further period of six weeks’ thereafter.
Resultantly, writ petition stands disposed of.
