Mr. Vijoy Kumar Sinha, learned counsel for the appellant, appears and informs that the sole appellant has died in the month of December, 2019 and as such, this appeal has become incompetent to proceed.

In above view of the matter, this appeal is dismissed having become incompetent to proceed with. However, it is made clear that in case some benefits accrue to the heir(s) and legal representative(s) of the deceased-appellant, who do not have any knowledge of the proceeding, it would be open for him/them to file a petition for reopening of this appeal.

Consequent to dismissal of this appeal, I.A. No. 4945 of 2019 also stands disposed of.
