Heard, learned counsel for the petitioner, Mr. Rohit Ranjan Prasad.

Learned counsel for the petitioner has sought permission to make necessary correction in para-3 of the supplementary affidavit. Permission is granted.

Learned counsel for the petitioner has submitted that earlier prayer for anticipatory bail application of the petitioner was allowed vide order dated 12.04.2019 passed in A.B.A. No. 7449/2018 in connection with Hunterganj P.S. Case No. 150/2018 registered under Sections 272/273/414/120B/34 I.P.C. and Section 47A of the Excise Act.

Learned counsel for the petitioner has submitted that because of unavoidable circumstances that to medical ground of his sole sister, the petitioner failed to execute the bail bonds within time frame granted by this Court, as such, this Court extent the same as petitioner himself tender to pay Rs. 40,000/- as penalty for such delay.

Learned counsel for the State, Mrs. Vandana Bharti, Additional Public Prosecutor has opposed the prayer for bail and has submitted that this Court has granted anticipatory bail and if on fine, the period is extended, it may be extended, but the fine amount shall be deposited before the District Legal Services Authority, Chatra within a period of four weeks and if petitioner surrender before the trial court and furnished the bail bonds in terms of order dated 12.04.2019, the same shall be accepted by learned trial court on showing of receipt of deposition of the said amount.

Petitioner shall also appear before the trial court on each and every date fixed for his personal appearance, failing which, the trial court shall cancel the bail bonds of the petitioner.

Accordingly, Cr.M.P. No. 1190/2020 is allowed.
