Perused the report vide Letter No.277/20 dated 24.09.2020 sent by learned Judicial Magistrate 1^st Class, Civil Court, Pakur, whereby it has been submitted that the matter is under further investigation by the permission of the Court to the CID and after submission of the charge-sheet, the trial of this case may be concluded after about 12-14 months.

Heard, learned counsel for the petitioner, Mr. Purendu Kr. Jha and learned counsel for the State, Md. Azeemuddin.

Learned counsel for the petitioner has submitted that petitioner has prayed for grant of regular bail in connection with Littipara P.S. Case No.35 of 2017 (corresponding to G.R. No.403 of 2017), for the offence registered under Sections 406/420 IPC.

Learned counsel for the petitioner has submitted that he is ready to comply the previous order and submitted that petitioner (Bahul Mondal) who is in custody since 30.05.2018, as there was some material collected during investigation by the Police team and the charge-sheet has been submitted, but subsequently the case has been taken-over by the CID and further investigation of this case is continuing, as such, this petitioner may be enlarged on bail on any condition that he shall make himself available before the investigating officer, and he shall appear before them whenever they shall ask him to appear through his father's Mobile No.91627-07677. The petitioner also undertakes that he will not abscond as the status report of this case has also been called for which say so.

Learned counsel for the State has opposed the prayer for bail and submitted that there is sufficient material in the case diary which shows the complicity of the petitioner. Block Development Officer and beneficiaries have also alleged against the petitioner, as such, he may not be enlarged on regular bail.

After hearing, learned counsel for the parties and perusing the materials brought on record and looking to the facts and circumstances of the case and considering the custody of petitioner i.e. 30.05.2018 and considering the report

submitted by the learned trial court that after submission of the charge-sheet, the trial of this case may be concluded after about 12-14 months, this Court is inclined to grant Bail to the petitioner. Accordingly, petitioner (Bahul Mondal), is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1^st Class, at Pakur in connection with Littipara P.S. Case No.35 of 2017 (corresponding to G.R. No.403 of 2017) on the following conditions:-

(i) One of the bailors shall be deponent/parivikar of the present case namely, Dipen Mandal, S/o Late Visvanath Mandal, R/o Village- Littipara, Ward No.8, P.O.& P.S.- Littipara, District- Pakur (Jharkhand), who has furnished photocopy of his UID Card bearing No.4195 6250 3448 before this Court in the bail application.

Office is directed to send photo copy of the UID Card bearing No. 4195 6250 3448 of deponent along with this order to the court below so as to verify the authenticity of the bailor.

(ii) Another bailor shall be mother/father/brother/sister/son/wife.

( iii ) Petitioner shall appear before the investigating officer and shall appear before the Officer-in-Charge, Littipara Police Station, Pakur whenever they call him on his father's Mobile No.91627-07677 furnished by learned counsel for the petitioner.

(iv) The Jail Authority shall release the petitioner only after his medical check-up. (v) The Civil Surgeon, Pakur is directed to medically examine the petitioner at the time of his release and if require, petitioner shall be taken for quarantine, but if no such requirement is there, he shall be released forthwith, if not wanted in any other case.

(vi) Petitioner shall also comply with all the guidelines issued by the Government to meet the challenges of Covid-19, as the country is passing through Pandemic of Covid-19.
