Heard learned counsel for the petitioner and learned counsel appearing for the State assisted by the learned senior counsel for the informant.

Petitioner has been made accused in connection with S. T. Case No. 568 of 2018 arising out of Kanke P.S. Case No. 79 of 2018 corresponding to G. R. No. 3170 of 2018.

The prayer for bail of the petitioner was earlier rejected in B.A. No. 10356 of 2018 with a liberty to the petitioner to renew his prayer for bail if the trial is not concluded within a period of one year.

The allegation reveals that the son of the informant was abducted by the accused persons. The confession of the accused persons further reveals that it was Gulzar Hussain who had shot at the son of the informant. Some of the co-accused persons, namely, Pawan Yadav @ Pawan Ram and Golu Singh @ Amit Kumar have been granted bail by this Court in B.A. No. 135 of 2020 and B.A. No. 7380 of 2019 respectively. In fact in B.A. No. 135 of 2020 since an apprehension was made by the learned senior counsel for the informant regarding the threatening being given by the accused to the witnesses learned trial court was directed to ensure that sufficient protection is given to the witnesses. It was further directed in the said case that the trial shall be concluded within a period of four months. However, it appears that due to the prevalent situation arising out of the pandemic no further progress is being made in the trial.

Be that as it may considering the fact that similarly situated coaccused persons have been granted bail by this Court, the above named petitioner is directed to be released on bail, on furnishing bail bond of Rs. 10,000 (ten thousand) with two sureties of the like amount each to the satisfaction of learned AJC-VI, Ranchi, in connection with Kanke P.S. Case No. 79 of 2018 (G.R. No. 3170 of 2018).
