Heard the learned counsel appearing for the respective parties.
The defects, as pointed out, by the office, are ignored.
The petitioner is an accused in connection with Special POCSO Case No.06 of 2020 arising out of Sadar (Satbarwa) P.S. Case No.51 of 2014.
It has been alleged that the informant was abducted by the petitioner and she was taken to Madhya Pradesh where she was subjected to rape. It has also been alleged that the petitioner had obtained a marriage registration certificate on the basis of false certificate of the informant. She was repeatedly subjected to rape. However, she somehow managed to make a phone call to her brother and thereafter, she was rescued. It appears that a marriage certificate has also been brought on record regarding the marriage between the petitioner and the informant which seems to have been solemnized at Daltonganj.
Learned counsel for the petitioner submits that the MGNREGA job card indicates that the informant is aged about 19 years and it has also been stated that the petitioner is in custody since 23.07.2019.
It appears from the First Information Report that the informant remained at various places for a considerable length of time but no hue and cry was ever raised by her.
On consideration of the entire facts of the case, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Exclusive Spl. Judge, POCSO Act, Palamau at Daltonganj in connection with Special POCSO Case No.06 of 2020 arising out of Sadar (Satbarwa) P.S. Case No.51 of 2014.
