03/26.02.2020 Heard Mr. Anjani Kumar, learned counsel for the petitioners and Mr. Ram Prakash Singh, learned A.P.P. for the State.
Petitioners have been made accused in connection with Bandgaon P.S. Case No. 14 of 2010 corresponding to G. R. No. 125 of 2010 (S. T. Case No. 68 of 2011(S)).
The dead bodies of the parents of the informant was found in a decomposed state. The accused persons were suspected due to previous enmity.
The case diary has been perused and it appears that Paragraph – 7 contains the statement of Jura Munda who has stated that he had seen the accused persons following the parents of the informant. The same statement has been reiterated by the other witnesses in Paragraphs – 8, 9 and 10 of the case diary. Paragraph – 33 of the case diary contains the statement of Mangra Sandi Purty who happens to be the eye-witness and he had stated that Chandiya and Soma Sandi Purty had assaulted the parents of the informants with sharp cutting weapon. Paragraph – 34 contains the statement of Etwa Sandi Purty who has reiterated the same things. The confessional statement of Soma Purty, Titu Purty and Pandu Purty have been recorded at Paragraphs – 37, 38 and 39 of the case diary pursuant to which danda and the skull of the child was recovered which finds place at paragraph – 43 of the case diary.
It appears that co-accused Soma Munda has been granted bail by this Court in B.A. No. 8339 of 2010. So far as the present petitioners are concerned, no specific allegation of any overt act has been alleged against them and as regards the recovery of the skull of the child is

concerned, as stated above, it has been attributed to Soma Purty, Titu Purty and Pandu Purty.
Regard being had to the aforesaid facts, the petitioners, named above, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge – III, Chaibasa, in connection with Bandgaon P.S. Case No. 14 of 2010 corresponding to G. R. No. 125 of 2010 (S. T. Case No. 68 of 2011(S)).
