03/05.10.2020 Heard Mr. Suraj Singh, learned counsel appearing for the petitioner and Mr. S.P. Jha, learned A.P.P. for the State.
The petitioner is an accused in connection with Nimdih P.S. Case No. 40 of 2019, corresponding to G.R. Case No. 584 of 2019 (Sessions Trial Case No. 190/2019).
The maternal aunt of the informant was murdered by the accused persons.
It appears that three witnesses have been examined and all have been declared hostile by the prosecution. The case diary has been perused and it appears that para 11 contains the confessional statement of co-accused Tota Murmu. Para 17 of the case diary reveals that the headless corpse of the deceased was recovered on the pointing out by Tota Murmu. The petitioner seems to have been implicated on suspicion and the main allegation appears to have been levelled against Tota Murmu.
Regard being had to the above, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned Principal District & Sessions Judge, Seraikella in connection with Nimdih P.S. Case No. 40 of 2019, corresponding to G.R. Case No. 584 of 2019 (Sessions Trial Case No. 190/2019).
