2. As prayed for by learned counsel for the petitioner, the defects as pointed out by the office, are hereby ignored for the time being.

3. The petitioner is apprehending his arrest in connection with Sadar P.S. Case No.123/2019, registered for the offence under Sections 414 IPC, u/s 21 (4) Mines and Minerals (Development and Regulation) Act, U/s 54 (4) of JMMC Rules and u/s 9 (i)/13 The Jharkhand Minerals (Prevention of illegal Mining Transportation and Storage) Rule 2017, pending in the court of learned C.J.M, Palamau at Daltonganj.

4. The learned counsel for the petitioner submits that petitioner is quite innocent and he has falsely been implicated in this case and the entire story is false and fabricated. He further submits that he is owner of tractor and he is ready to abide the condition as imposed by this Court and the learned trial court.

5. Learned APP for the State opposed the prayer for anticipatory bail.

6. Taking into consideration the overall circumstances, I am inclined to allow this application, the petitioner, named above, is directed to surrender in the court below within four weeks from today and in the event of his

arrest/surrender, the court below is directed to enlarge him on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M, Palamau at Daltonganj, in connection with Sadar P.S. Case No.123/2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
