Heard the learned counsel for the respective sides.
So far as the defects No. 9(iii) and 9(iv) are concerned, learned counsel for the petitioners undertakes to remove the same once the situation normalizes. As regards the rest defects, as pointed out by the office, are concerned, the same are ignored.
The petitioners apprehend their arrest in connection with Sahibganj (M) P.S. Case No. 143 of 2019.
It has been alleged that while the informant for getting his field cultivated, the accused persons variously armed had arrived and committed assault upon the driver of the tractor. The accused persons had also demanded Rs. 2 Lakhs as extortion money from the informant.
Some of the co-accused persons have been granted anticipatory bail by this Court in A.B.A. No. 508 of 2020. There appears to be a previous enmity between the parties as there are a spate of cases instituted against each others. In such circumstances, the false implication of the petitioners cannot be ruled out. The petitioners are accordingly directed to surrender before the learned court below within four weeks from today and on such surrender, they shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sahibganj in connection with Sahibganj (M) P.S. Case No. 143 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This application stands allowed.
