06/ 01.07.2019 In the instant writ petition, petitioner has prayed for giving the benefits of

revised pension based upon the recommendation of the 7^th Pay Commission with interest @ 18% per annum.

At the very outset learned counsel for the petitioner submits that suffice it would be if a direction is given to the respondent-authorities, particularly, Pension Disbursing Authority to consider the case of the petitioner and if it is found that the petitioner is entitled for the benefits, as prayed for by him, in view of Clause 16.5 and 18 of the Planning-cum-Finance Department’s resolution dated 18.01.2017, the respondents may further be directed to extend the said benefits.

Learned counsel for the respondents has no objection to the said prayer.

Be that as it may, having gone through the fair submission of the parties, I hereby direct the petitioner to file a representation claiming revised pension, before the concerned authorities, within a period of two weeks from the date of receipt/ production of a copy of this order. Upon receipt of such representation, the respondent shall consider case of the petitioner, taking into account Clause 16.5 and 18 of the aforesaid resolution and after providing ample opportunity of hearing to him, pass a reasoned order, in accordance with law, preferably within a period of six weeks from the date of receipt of the

representation of the petitioner.

It goes without saying that if the petitioner is found entitled for the relief, as

prayed for, the same may be extended to him within a further period of three weeks.

With the aforesaid observations and directions, the writ petition stands

disposed of.
