03/ 01.07.2019 The petitioner has approached this Court with a prayer for a direction upon the respondents to take a decision on the representation preferred by the petitioner regarding calculation of retiral benefits of the petitioner made under the reasoned order as contained in Memo No. 675 dated 29.03.2012 and further prayer has been made to release the retiral benefits.

At the very outset, learned counsel for the petitioner submits that suffice it would be if the present writ petition be treated as a representation of the petitioner and a direction is given to the respondents to pass a reasoned order on the representation of the petitioner, within stipulated time.

No counter-affidavit has been filed. However, Dr. A.K. Singh, learned counsel appearing on behalf of the respondents does not object to the submissions of the learned counsel for the petitioner.

In view of the submissions made by the learned counsel for the parties, let the present writ petition be treated as a representation of the petitioner and petitioner is directed to approach the respondents with a copy of this writ petition, a copy of this order and any other document upon which he is relying, within a period of three weeks from the date of receipt of a copy of this order. On receipt of such representation, the respondents are directed to consider the case of the petitioner and pass a speaking order assigning valid and concrete reason for consideration /non-consideration of the case of the petitioner, in accordance with

law with a copy to the petitioner, within a period of six weeks thereafter. It is made clear that the respondents shall provide ample opportunity of hearing to the petitioner.

Needless to say that if the petitioner is found entitled for the due benefits as claimed in prayer portion of the writ petition, the same shall be extended to him as per the scheme applicable for the employees of JMADA, within a period of six weeks, thereafter.

With the aforesaid directions, this writ petition stands disposed of.
