09/17.06.2019 Petitioner has approached this Court for a direction upon the respondents to pay retiral benefits on different heads and also for granting the benefits of ACP/MACP.
Mr. Ashish Kumar Shekhar, AC to learned GP-II submits that case of the petitioner has already been duly considered and post retiral benefits have already been paid to him. Learned counsel draws attention of this Court towards paragraphs7, 18 and 31 of the supplementary counter affidavit filed on behalf of the respondent no. 5 and submits that petitioner is not entitled for the benefits of ACP/ MACP as his services were not regularized and there is break of service on several occasions.
In view of submission of learned counsel for the State and also in view of specific averments made in paragraphs-7, 18 and 31 of the supplementary counter affidavit filed on behalf of the respondent no. 5, nothing remains to be decided.
This writ petition is accordingly disposed of.
