This writ petition has been filed by the petitioner invoking jurisdiction under section 226 of the Constitution of India seeking direction in the nature of mandamus commanding upon the respondents concern, particularly respondent no. 5 for considering the representation submitted by the petitioner for reevaluation/re-checking of the Answer-sheets, which according to the petitioner, has not been properly evaluated and consequent thereto he was not chosen successful as per the result declared vide memo no. 3868/GO. Dated 21/10/2011 (Annexure-3) from the office of Respondent no. 5 which published in the Newspaper (Dainik Jagran) on 24.10.2011 and for further direction to respondents to appoint the petitioner on the post of constable for which he had applied for the District of Hazaribagh against the Advertisement No. 01/2010 (Annexure-1).

A counter-affidavit has been filed on behalf of respondent no. 5.Superintendent of Police, Giridih in which in para 9 it has been stated that roll number allotted to the petitioner was 37088. His date of birth is 26.04.1990. The

Petitioner had secured 10 points in running, 8 points in high jump and 9 points in long jump. He qualified in short-put throw. Thus, the petitioner secured total 27 marks in physical. The petitioner secured qualifying marks in Hindi language test. In the original language test petitioner secured 64 out of 100 marks for which 4 marks allotted to him as per recruitment guide line. Educational qualification of the petitioner is class 7^th pass. Thus, the petitioner was allotted total 31 points as per the guidelines given in the recruitment advertisement.

In para 18 of the counter-affidavit it has been stated that the last selected candidate is Vikram Kr. Toppo, whose date of birth is 18.11.1989 who has obtained 32 points in total.

In view of the averment made in the counter-affidavit and in view of the fact that the relief sought for by the petitioner, is of the year, 2011, I find no merit in this writ petition. Accordingly, this writ petition is hereby dismissed.
