The petitioner is apprehending his arrest in connection with Bengabad P.S. Case No. 369/2017, the case registered under Sections 34/175/414 of the Indian Penal Code and section 4/5 of Explosive Substance Act.

It appears that earlier anticipatory bail application of the petitioner is rejected on by this Bench on 14.06.2018 in ABA No.1898/2018. This is the second anticipatory bail application.

Heard learned counsel for the parties.

On 21.06.2019 learned counsel for the petitioner has submitted that some of the final form co-accused has faced the trial in Session Trial No.115/2018 before the court of District & Sessions Judge-IV, Giridih and in the trial, P.W.1 namely, Praveen Kumar has deposed that when the police along the informant reached the mining site, petitioner was not present , P.W.2 has deposed that nothing has been recovered from the mining lease in his presence and P.W.3 has deposed that he has never disclosed the name of this petitioner.

A supplementary affidavit dated 02.08.2019 has been filed on behalf of the petitioner, wherein at paragraph no.4 it is stated that till date no proceeding U/s 81/82 has been issued against the petitioner in this case.

Learned A.P.P opposed the prayer for bail.

Keeping in view the arguments advanced by the learned counsel for the parties and also considering the fact and circumstances of the case, the petitioner is directed to surrender in the Court below within Four Weeks from the date of this order and in the event of his arrest or surrender, the Court below shall enlarge the above named, petitioner, on bail, on furnishing bail bond of Rs. 30,000/- (Rupees thirty thousand) with two sureties of the like amount each to the satisfaction of J.M.Ist Class, Giridih, in connection with Bengabad P.S. Case No. 369/2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C and subject to the further condition that petitioner shall deposit Rs. 25,000/ - with the Advocates' Sports Club, Jharkhand High Court, Ranchi on or before the date of his surrender in the trial court and produce the receipt of the said deposit in the trial court, thereafter his bail bonds will be accepted.

Let a copy of this order be communicated to the court below and the learned counsel for the parties.
