This matter is of the year 2009 and State has not filed the counter affidavit as yet.

2. The petitioners have preferred this writ petition for direction upon the respondents to consider the case of the petitioners for their appointment on the post of Panchayat Sewak within a specified period.

3. Learned counsel for the petitioners submits that the petitioners were appointed on the post of Dalpati and since they are regularly discharging their duties without any break. In the seniority list of Dalpatis, the name of petitioner no. 1 figures at serial no. 33 and name of petitioner no. 2 figures at serial no. 37, but the case of the persons whose names appear below the petitioners in the seniority list has been considered and the case of the petitioners have not been considered although they are fulfilling all the eligibility criteria.

4. Considering the averments made in the writ petition and the fact that till date no counter affidavit has been filed, this Court without entering the merit of the case directs respondent

no. 2 to take a decision with regard to prayer made by the petitioners in the present writ petition, within a period of eight weeks from the date of receipt of fresh representation of the petitioner along with copy of this order. The petitioner shall file a fresh representation within a period of two weeks from today. 5. With the aforesaid observations and direction, the writ petition stands disposed of.
