Mr. Rajesh Kumar, learned counsel appearing for the petitioner, submits that the petitioner was working as a ‘Semi Clerk’ in Central Coalfields Limited (CCL) with effect from 18.06.1974 and he was granted his due promotion to the post of ‘Office Superintendent’ from the post of ‘Senior Clerk’ vide office order dated 31.03.2003. He further submits that there is no time prescribed in the promotion order to join on the new post. Subsequently, the promotion of the petitioner was kept in abeyance vide office order dated 26.04.2003. The petitioner applied for wavier of abeyance order on 02.05.2003 by which the promotion of the petitioner has been kept in abeyance. The petitioner was allowed to join on the promotional post vide letter dated 7/8.08.2003 with effect from 02.05.2003. On this ground, learned counsel for the petitioner submits that there is no fault on the part of the petitioner regarding joining the said post and, therefore, the impugned order is fit to be quashed. The argument is stressed on the point that the promotional order was kept in abeyance and that is why the petitioner was not able to join on the promotional post within 30 days from the date of issuance of the order. Mr. Rajesh Kumar, leaned counsel for the petitioner, further submits that the abeyance letter has been issued prior to expiry of 30 days.
