1. Heard Mr. Rajiv Kumar for the petitioners and Mr. Rajiv Kumar Sinha for the respondent Bank.

2. During pendency of the writ petition the petitioner died and therefore, name of the petitioner has been substituted with his legal heirs in this writ petition.

3. This is the third writ petition on behalf of the petitioner. The petitioner has preferred this writ petition for a direction to the respondents for payment of arrears of salary for the period spent on duty for the revised pay scale as per 7^th bipartite settlement.

4. Mr. Rajiv Kumar, counsel appearing for the petitioner, submits that the petitioner took Voluntary Retirement, which was allowed on 30.11.1999. He submits that though 7^th bipartite settlement was signed on 27.03.2000, it was given effect from 01.11.1997 and as such the petitioner is entitled for difference of salary with effect from 01.11.1997 till the date of his Voluntary Retirement and this amount has not been paid.

5. On the other hand, counsel for the respondent Bank submits that all dues of the petitioner has been paid. Mr. Rajiv Kumar draws the attention of this Court to paragraph No. 13 of the counter affidavit and submits that in Paragraph No.6

of the writ petition, the petitioner has stated that his salary has not been paid, which has not been specifically denied in Pararaph No. 13 of the counter affidavit.

Learned counsel for the respondent Bank has also not been able to show as to whether the arrears of salary of the petitioner with effect from 01.11.1997 till the date of his Voluntary Retirement has been paid in terms of 7^th bipartite settlement which has been signed on 27.3.2000 and given effect to from 01.11.1997.

Accordingly, legal heirs of the petitioner substituted in this writ petition are directed to file a fresh representation before the respondent Bank and respondent Bank in its turn will pass a speaking order providing the details of the payment made in terms of 7^th bipartite settlement within six weeks from the receipt/production of a copy of this order.

8. This writ petition is disposed of with the aforesaid observation and direction.
