Ram Pravesh Tiwary Vs State of Jharkhand And Ors.

Mr. Sidhartha Roy, the learned counsel appearing for the petitioner submits that he is not able to contact his client. He further submits that in the writ petition the prayer is made for promotion of the petitioner to the post of Sub-Inspector of Police. He submits that he is not able to contact his client and he is not in a position to submit as to whether the cause of action is still surviving or not.

He fairly submits that writ petition may be permitted to be withdrawn with liberty to the petitioner to approach this Court by way of another writ petition if the cause of action still survives.

In view of the fair submission of Mr. Sidhartha Roy, the learned counsel for the petitioner, the writ petition is permitted to be withdrawn with liberty as aforesaid.

The writ petition is dismissed as withdrawn.
