The present writ petition has been filed by invoking writ jurisdiction under Article 226 of the Constitution of India with a prayer mentioned at para-1 of the writ petition.

Under order dated 02.12.2019, learned counsel for the respondent was directed to produce any Circular / Notification whereby against the order of Deputy Commissioner, appeal before the Commissioner will lie or not.

Pursuant thereto a supplementary counter affidavit dated 05.12.2019 has been filed brought on record the Circular / Notification bearing no.03/134/2002 dated 02.06.2006, issued under the signature of Secretary, Social Welfare Woman and Child Development, Department, Government of Jharkhand, which laid down detailed guideline for engagement of 6683 Anganwari Sevika / Sahaika under Integrated Child Development Scheme wherein at clause 17 provides that in the case of violation of the provisions, the Director Social Welfare may cancel the selection of the Sewika and Sahaika and an appeal against this order shall lie before the Departmental Secretary.

In view of the circular / Notification, petitioner is directed to file an appeal against the impugned order before the Departmental Secretary, Social Welfare Woman and Child Development, Department within

Eight Weeks and thereafter the Secretary after giving due notice decide the matter.
