The writ petition is under Article 226 of the Constitution of India, whereby and whereunder the notice of demand has been issued against the petitioner.
Counter affidavit has been filed on behalf of the State respondent, inter alia therein the stand has been taken that apart from initiation of departmental proceeding a proceeding under Bihar and Orissa Public Demands Recovery Act, 1914 has been initiated.
Learned counsel for the petitioner, on instruction, has submitted in course of argument that a proceeding under the Public Demands Recovery Act has been initiated which the petitioners are contesting.
In view of such admitted fact since the said demand has been culminated into Public Demands Recovery Act, therefore, the writ petition is disposed of giving liberty to the petitioner to pursue the proceeding as initiated under the Public Demands Recovery Act which will be considered by the competent authority/forum in accordance with law.
