1. This matter is identical to W.P.(S) No. 3629 of 2008 and the respondent State has already given the benefit to the petitioner of that case as has been stated in the counter affidavit filed in the said case.

Therefore, in the light of the counter affidavit of the respondent State, this writ petition is disposed of with a direction to Respondent No.3 to provide the benefit to this petitioner also as has been done in the case of Suchand Singh Sardar in W.P.(S) No. 3629 of 2008, if it has already not been given.

It is expected that the benefit will be released in favour of the petitioner/legar heir of the petitioner, if it is already not done, within eight weeks from the date of production/receipt of a copy of this order. 3. With these observation and direction, this writ petition is disposed

1. Petitioner has preferred this writ petition for payment of salary for the period from 01.01.1971 to 31.3.1973 along with statutory interest. Prayer is also made for payment of balance amount of General Provident Fund for the period from the year 1973-74 to 1985-86 along with up to date statutory interest.

Mr. Giri, appearing for respondents, at the outset, referring to Paragraph 7 and 8 of the counter affidavit, submits that entire G.P.F. amount has been paid and so far as the amount with respect to the salary for the period from 01.01.1971 to 31.3.1973 is concerned, it has already been sanctioned through Order dated 07.08.2009

In view of the submissions made in the counter affidavit, this writ petition is disposed of with a direction to Respondent No.3, viz. the District Superintendent of Education, Saraikela Kharsawan to ensure that the payment in view of sanction order dated 07.8.2009 is made to the petitioner/legal heir of the petitioner, if it has not been paid already, at the earliest and not later than 4 weeks from the date of production/receipt of a copy of this order.
