The writ petition is under Article 226 of the Constitution of India, whereby and whereunder direction has been sought for upon the respondents to pass final order in Doubtful Jamabandi Case No.19 of 2009-10 which is still pending in the Court of Sub Divisional Officer, Ramgarh.

It is the case of the petitioner that he has purchased the land from Hindlal Paswan who happens to be son of Phulwati Devi. The petitioner is ready to make payment of rent after having title over the said land created by virtue of the registered sale deed but due to pendency of the Doubtful Jamabandi Case No.19 of 2009-10, the same is not being accepted, therefore the instant writ petition.

Counter affidavit has been filed whereby and whereudner the fact about Doubtful Jamabandi Case No.19 of 2009-10 has not been disputed.

In view thereof, without entering into the claim of the petitioner the writ petition stands disposed of, directing the Sub Divisional Officer, Ramgarh to take final decision in Doubtful Jamabandi Case No.19 of 200910 within a period of three weeks from the date of receipt of copy of the order, if not already disposed of.

It goes without saying that the affected parties will be provided opportunity of hearing before taking final decision in the aforesaid case.
