It is the case where direction has been sought for upon the respondents to pay the amount of compensation in lieu of the acquisition of land of Village Damgara by initiating a fresh proceeding under the provision of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.
Learned counsel for the petitioner at the outset has submitted that after going through the contention made in the counter affidavit whereby and whereunder it has been stated that the amount of compensation has been paid and even the possession of land has been taken by the concerned authority, therefore, the provision of the Act, 2013 is not applicable in view of specific stipulation made under Section 24(2) of the Act, 2013.
He further submits that since the amount of compensation has already been paid as would be evident from page 25 which is part of counter affidavit annexed as Annexure-A, issued by the District Land Acquisition Officer, Deoghar he is not pressing the writ petition.
In view thereof the writ petition has been rendered to be infructuous, accordingly stands disposed of.
