06/08.07.2019 Petitioner has approached this Court with a prayer for quashing the letter contained in Ref. No. 1284, dated 17.10.2015, whereby he has been informed that his case cannot be forwarded to Zonal Office (East), Kolkata for settlement of his pension under EPS-1995 because in the letter dated 19.05.2000, his name was included at Serial No. 2 indicating that he is not a member of FPS. Petitioner has also prayed for a direction upon the respondents to fix his pension in pursuance of Employees’ Pension Scheme, 1995 and to make payments of arrears accrued thereupon as well as month to month pension.

After some arguments, learned counsel for the petitioner seeks permission to withdraw this writ petition in order to enable him to move before appropriate forum.

Prayer is allowed.

This writ petition is accordingly dismissed as withdraw with a liberty to the petitioner to approach before appropriate authority. If petitioner approaches before the appropriate authority, the concerned authority shall consider his grievance in accordance with law. The authority concerned shall consider to condone the delay, if any, in approaching the authority concerned considering the fact that petitioner had approached this Court.
