The father of this petitioner namely Rajan Nayak was working as “Safaiwala” in the Cantonment Board, Ramgarh since 07.12.1987. His father died in harness on 13.12.2011. The petitioner vide letter dated 03.02.2012 applied for grant of compassionate appointment. The said application was received by the Cantonment Board, Ramgarh on 03.02.2012 with the proforma which was also filled up. The respondents did not pass any order on the application of the petitioner thus, a reminder was also send by the petitioner on 03.06.2015. The petitioner having no other alternative, approached this court by filing this writ application, praying for appointment on the compassionate ground. A counter affidavit has been filed by the respondent nos. 3 and 4. They admit that an application was filed by the petitioner for grant of compassionate appointment, but in the counter affidavit they said that since six years have already lapsed there is no purpose of compassionate appointment. Their claims is that due to passage of the six years the petitioner must have overcome the financial crisis. Thus, he is not entitled for compassionate appointment.
